1. General Terms and Acceptance

* 1.1. Introduction and Agreement: These Terms and Conditions ("T&C") govern the use of the website https://www.mammothbhrt.in and the purchase of goods offered by MAMMOTH BHARAT, a sole proprietorship operating from Sindagi Taluk, Vijayapura District. By placing an order, the customer agrees to be bound by these T&C, along with the Privacy Policy and Refund/Cancellation Policy.

* 1.2. Business Status Disclosure: You acknowledge that MAMMOTH BHARAT is a sole proprietorship business, and the owner is personally responsible for all business liabilities (Unlimited Liability).

2. Product Description and Natural Variation      

* 2.1. Product Nature: MAMMOTH BHARAT deals exclusively in natural, farm-grown, and fresh-catch perishable agricultural products (Lemons, Mangoes, Sugarcane, Raw Cotton, Freshwater Fish like Snake Head Murrel and Tilapia).

* 2.2. Acknowledgment of Natural Variance (Key Clause): You understand and agree that due to the natural origin and harvesting process of all products (including, but not limited to, fruit and fish), the goods delivered may exhibit natural variations that differ from the images and descriptions on the Website. These variations may include:

* Size, Weight, and Shape: Products are sold by average weight/count/size, and individual items may vary.

* Colour and Appearance: Colour, ripeness, external blemishes, and shape may vary based on harvest batch, season, and variety.

* Internal Quality: Internal characteristics like juice content, seed size, sugar levels (Brix), texture, and fish flesh firmness are subject to natural factors and cannot be guaranteed to match a specific expectation.

* 2.3. Quality Guarantee: MAMMOTH BHARAT guarantees that despite natural variations, all products are checked to meet our internal standards for grade, freshness, and suitability for consumption at the time of dispatch.

* 2.4. Raw Cotton Disclaimer: For Raw Cotton (if sold as a commodity), the product description regarding grade, staple length, and moisture content will be based on standard industry parameters but remain subject to inherent natural variance.

3. Pricing, Payments, and Taxes

* 3.1. Pricing: All prices are displayed in Indian Rupees (INR) and are subject to change without prior notice.

* 3.2. GST and Other Taxes: Prices are inclusive of all applicable taxes, including GST, unless explicitly stated otherwise.

* 3.3. Payment Gateway: We use a third-party payment gateway (Razorpay) for processing payments. MAMMOTH BHARAT is not responsible for any technical issues or service interruptions on the part of the payment gateway.

3. Order Fulfilment and Pickup (Revised Core Clause)

* 3.1. Primary Mode of Fulfilment (Pickup): All sales through the Website are primarily fulfilled via customer pickup (Farm-Gate Sale). The customer is responsible for arranging their own transportation, vehicle, and manpower to collect the goods from the specified MAMMOTH BHARAT location in Sindagi Taluk, Vijayapura District.

* 3.2. Pickup Schedule: The customer must adhere to the confirmed pickup time and date communicated by MAMMOTH BHARAT after the order is placed and payment is received.

* 3.3. Risk Transfer at Pickup (Critical Clause): The risk of loss, damage, spoilage, or deterioration of the goods passes entirely to the customer the moment the goods are loaded onto the customer's vehicle or handed over to the customer (or their representative) at the MAMMOTH BHARAT premises. The customer is solely responsible for ensuring the adequacy of their vehicle (e.g., proper temperature, secure packaging) for transporting perishable items like fish and fruit.

* 3.4. Inspection at Pickup: The customer (or their representative) is required to inspect the quality, quantity, and grade of the goods thoroughly at the time of pickup. By accepting and loading the goods,  the customer acknowledges and confirms that the products are in satisfactory condition and meet the order specifications.

4. Optional Delivery Service (Limited to Karnataka)

* 4.1. Limited Delivery Scope: MAMMOTH BHARAT may, upon specific request and agreement, offer a limited delivery service, exclusively within the state of Karnataka.

* 4.2. Delivery Non-Assurance (No Guarantee): This delivery service is NOT ASSURED or guaranteed. It is offered at the sole discretion of MAMMOTH BHARAT, and may be subject to vehicle availability, order size, and logistics feasibility. MAMMOTH BHARAT reserves the right to cancel the delivery option at any time, in which case the transaction reverts to a pickup (Clause 3).

* 4.3. Delivery Charges: All delivery services will incur separate, mutually agreed-upon charges, which must be paid in advance.

* 4.4. Risk Transfer on Delivery: If MAMMOTH BHARAT agrees to deliver, the risk of loss, damage, or spoilage passes to the customer upon successful delivery at the specified address. For perishable goods, the customer must be available to accept the delivery immediately.

5. Returns and Refunds (Revised for Pickup)

* 5.1. Quality Disputes at Pickup: No claims for damage, defect, quantity shortage, or quality issue will be entertained after the goods have left the MAMMOTH BHARAT premises, as the customer is responsible for inspection at the time of pickup (as per Clause 3.4).

* 5.2. Refund for Undeliverable Orders: If MAMMOTH BHARAT agrees to delivery (Clause 4) but is unable to complete it due to logistics failure on our part, a full refund of the product and delivery charges will be processed.

°5.3. Cancellation of order: Incase of cancellation of order before dispatch the amount shall be refunded within a week from the date of order. Cancellation is accepted if informed before dispatch.

6. Governing Law and Jurisdiction

* 6.1. Governing Law: This T&C shall be governed by and construed in accordance with the laws of India.

* 6.2. Jurisdiction: All disputes arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the Courts in Vijayapura District, Karnataka, where the business is physically located.
